Welcome to Caribbean Island Cafe. These Terms of Service ("Terms") govern your use of our website, online ordering services, and any related services (collectively, the "Services") operated by Caribbean Island Cafe, located at 944 West Innes Street, Salisbury, NC 28144.
By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.
Use of Services
By using our Services, you agree to:
- Provide accurate and complete information when creating an account or placing orders
- Maintain the security of your account credentials
- Use our Services only for lawful purposes
- Not interfere with or disrupt the operation of our Services
- Not attempt to gain unauthorized access to our systems
- Not use automated systems to access our Services without permission
Account Registration
You may place orders as a guest or create an account for a better experience. When creating an account:
- You must be at least 13 years old
- You must provide accurate, current, and complete information
- You are responsible for all activity under your account
- You must notify us immediately of any unauthorized use of your account
- We reserve the right to suspend or terminate accounts that violate these Terms
Online Orders & Payments
Order Acceptance: All orders placed through our website are subject to acceptance by our kitchen. We reserve the right to refuse or cancel any order for any reason, including but not limited to: product availability, errors in pricing or product information, or suspected fraud.
Payment Authorization: When you place an order, your payment method is authorized (a hold is placed) but not charged until your order is accepted by our kitchen. If we decline your order, the authorization hold is released and you will not be charged.
Payment Processing: All payments are processed securely through our payment provider. We do not store your credit card information. By placing an order, you authorize us to charge your payment method for the total order amount.
Pricing: Prices for menu items are displayed on our website and may differ from in-store prices. We reserve the right to change prices at any time without notice. The price charged will be the price displayed at the time of your order.
Order Pickup: Orders are for pickup only. You will receive an estimated pickup time when your order is accepted. Please pick up your order promptly.
Refunds & Cancellations
Before Kitchen Acceptance: If your order has not been accepted by our kitchen, the payment authorization will be released automatically and you will not be charged.
After Kitchen Acceptance: Once your order has been accepted and we have begun preparing your food, cancellations may not be possible. Please contact us immediately at (980) 432-5300 if you need to cancel an accepted order.
Quality Issues: If there is an issue with your order (wrong items, quality concerns, etc.), please contact us within 24 hours. We will work with you to resolve the issue, which may include a refund or replacement at our discretion.
Intellectual Property
All content on our website, including but not limited to text, graphics, logos, images, recipes, and software, is the property of Caribbean Island Cafe or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our express written permission.
Disclaimer of Warranties
OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:
- The Services will be uninterrupted, secure, or error-free
- The results obtained from using the Services will be accurate or reliable
- Any errors in the Services will be corrected
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARIBBEAN ISLAND CAFE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OUR SERVICES, REGARDLESS OF WHETHER WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Indemnification
You agree to indemnify, defend, and hold harmless Caribbean Island Cafe and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of our Services or violation of these Terms.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Rowan County, North Carolina.
